OVERVIEW

This website is operated by W24Cards. Throughout the site, the terms “W24Cards,” “we,” “us,” and “our” refer to W24Cards.

W24Cards provides this website, including the information, products, tools, features and services available through it, subject to your acceptance of these Terms of Service and any other policies referenced on the website.

By accessing our website, creating an account, placing an order, purchasing a product, or otherwise using our services, you agree to be bound by these Terms of Service (“Terms”).

These Terms apply to all users of the website, including visitors, customers and account holders.

Please read these Terms carefully before accessing or using our website. If you do not agree with these Terms, you should not use the website or purchase products through W24Cards.

Our online store may be operated using Shopify Inc. and other third-party service providers that provide e-commerce, payment processing, shipping and website functionality.

SECTION 1 – ONLINE STORE TERMS

By using this website or placing an order, you represent that you are legally capable of entering into the transaction or have the permission of a parent or legal guardian where required.

You may not use our website or products for any illegal, fraudulent or unauthorized purpose.

You must not:

  • Violate any applicable federal, provincial, state or local law;

  • Infringe the intellectual property rights of W24Cards or another party;

  • Attempt to interfere with the operation or security of our website;

  • Transmit viruses, malware or other harmful code;

  • Use automated systems to improperly access, scrape or interfere with the website; or

  • Use fraudulent payment information or engage in fraudulent purchasing activity.

A violation of these Terms may result in cancellation of orders, suspension of an account, refusal of service or termination of access to our website.

SECTION 2 – GENERAL CONDITIONS

W24Cards reserves the right to refuse service, cancel an order, restrict quantities or restrict access to our website where reasonably necessary, including in cases involving suspected fraud, payment disputes, abusive behaviour, inventory errors, pricing errors, security concerns or violations of these Terms.

We may limit quantities purchased by an individual, household, account, payment method, billing address or shipping address.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our website or services without our written permission.

The headings contained within these Terms are provided for convenience and do not affect the interpretation of the Terms.

Nothing in these Terms is intended to limit any rights available to a consumer that cannot legally be waived under applicable consumer protection legislation.

SECTION 3 – PRODUCT INFORMATION

W24Cards makes reasonable efforts to ensure that product descriptions, photographs, pricing, availability and other information displayed on our website are accurate.

However, errors or discrepancies may occasionally occur.

Product photographs may include manufacturer-supplied images, stock photographs or photographs of the actual product being sold.

Where a listing for an individual trading card contains photographs of the actual card, those photographs form part of the product description.

Colours, finishes and other visual characteristics may appear differently depending on your screen or device.

Product descriptions are provided for informational purposes and should be reviewed together with any available photographs before purchasing.

SECTION 4 – TRADING CARD CONDITION

Raw/Ungraded Cards

Unless otherwise stated, raw or ungraded trading cards are sold based on their observed condition and the photographs provided in the listing.

Condition assessments are inherently subjective.

W24Cards does not guarantee that any raw card will receive a particular grade from PSA, Beckett, CGC, SGC or any other third-party grading company.

A card described as appearing to be in a particular condition does not constitute a guarantee of a future professional grade.

Raw cards may contain imperfections including, but not limited to:

  • Print lines;

  • Surface marks;

  • Scratches;

  • Edge wear;

  • Corner wear;

  • Centering variations;

  • Manufacturer defects;

  • Factory marks;

  • Printing imperfections; or

  • Other characteristics commonly associated with trading cards.

Customers purchasing raw cards for professional grading are responsible for making their own assessment of the card before purchasing.

A third-party grading result that is lower than expected does not qualify a card for a return or refund.

SECTION 5 – PROFESSIONALLY GRADED CARDS

Cards sold in holders from PSA, Beckett, CGC, SGC or another third-party grading company are sold according to the information displayed on the holder and in the listing.

Unless expressly stated otherwise, W24Cards is not affiliated with or endorsed by any third-party grading company.

Grades, authentication determinations and designations are opinions or determinations made by the applicable grading company.

W24Cards does not control and is not responsible for:

  • The grade assigned by a grading company;

  • Changes to grading standards;

  • Registry status;

  • Population reports;

  • Label classifications;

  • Future regrading results; or

  • Decisions made if a card is submitted for crossover, review or reholdering.

A change in population report, grading standard or market perception after purchase does not entitle the purchaser to a refund or price adjustment.

SECTION 6 – SEALED PRODUCTS

W24Cards may sell factory-sealed products including hobby boxes, retail boxes, blaster boxes, tins, packs, cases and other sealed trading card products.

W24Cards does not manufacture these products and cannot guarantee their internal contents.

Unless expressly guaranteed by the manufacturer, we do not guarantee that any sealed product will contain:

  • A particular player;

  • Rookie cards;

  • Autographs;

  • Memorabilia cards;

  • Numbered cards;

  • Short prints;

  • Case hits;

  • Specific inserts;

  • Specific parallels; or

  • Cards of any particular value.

References to odds, average contents or expected product configurations are based on information supplied by the manufacturer and do not constitute a guarantee by W24Cards.

Once sealed packaging has been opened or altered, the product is final sale except where otherwise required by law.

SECTION 7 – PRE-ORDERS

Products identified as Pre-Order are products expected to become available at a later date.

Pre-orders generally require full payment at the time the order is placed.

Placing a pre-order reserves your requested product subject to manufacturer and distributor availability.

Allocation and Availability

Trading card products may be subject to manufacturer or distributor allocation.

W24Cards will make reasonable efforts to fulfill all confirmed pre-orders, but a pre-order does not constitute an unconditional guarantee that the full quantity ordered will be supplied.

Manufacturers or distributors may:

  • Reduce allocations;

  • Delay releases;

  • Change product configurations;

  • Change release dates;

  • Discontinue products; or

  • Cancel releases.

If W24Cards is unable to fulfill all or part of a pre-order because of allocation or manufacturer cancellation, the unfulfilled portion will be refunded in full to the original payment method.

Customer Pre-Order Cancellations

Customers may request cancellation of a pre-order until 14 days before the scheduled release date.

Approved customer-requested pre-order cancellations are subject to a 10% cancellation fee.

Pre-orders are final sale within 14 days of the scheduled release date and cannot be cancelled because of:

  • Changes in market price;

  • Changes in expected resale value;

  • Checklist announcements;

  • Player injuries or performance;

  • Market demand;

  • Product reviews; or

  • A change of mind.

Nothing in this section limits statutory cancellation rights that may apply under applicable consumer protection legislation.

SECTION 8 – PRICES AND MARKET FLUCTUATIONS

The value and market price of trading cards and collectibles can fluctuate significantly and without notice.

Product prices may change based on factors including:

  • Supply and demand;

  • Manufacturer pricing;

  • Distributor pricing;

  • Product availability;

  • Player performance;

  • Product checklists;

  • Market trends; and

  • Comparable market sales.

W24Cards may change the listed price of an unsold product at any time.

Once an order has been accepted, subsequent increases or decreases in market value do not change the agreed purchase price.

W24Cards does not provide retroactive price adjustments.

Customers are not entitled to a refund, credit or adjustment solely because an item is subsequently offered at a lower price.

Similarly, W24Cards will not increase the price of an accepted order solely because the market value subsequently increases.

SECTION 9 – PRICING AND LISTING ERRORS

Despite reasonable efforts to maintain accurate information, occasional pricing, inventory, description or technical errors may occur.

W24Cards reserves the right to correct genuine errors.

If an item has been listed at an obviously incorrect price because of a typographical, technical, database or system error, W24Cards may cancel the affected order and issue a full refund.

We will not substitute a different price without giving the customer the opportunity to decide whether to proceed, where appropriate.

W24Cards may also correct incorrect product descriptions, photographs, quantities, availability information or other listing errors.

Nothing in this section limits any rights available under applicable consumer protection legislation.

SECTION 10 – ORDER ACCEPTANCE

Receiving an automated order confirmation does not necessarily mean that an order has completed all payment, fraud, inventory or verification checks.

W24Cards reserves the right to review an order before shipment.

An order may be cancelled or held for additional verification where reasonably necessary because of:

  • Payment authorization issues;

  • Suspected fraudulent activity;

  • Billing or shipping address discrepancies;

  • Inventory discrepancies;

  • Duplicate orders;

  • Pricing errors;

  • Unusual purchasing activity; or

  • Violations of these Terms.

If W24Cards cancels an order after payment has been collected and the cancellation is not the result of customer misconduct, the applicable amount will be refunded.

SECTION 11 – BILLING AND ACCOUNT INFORMATION

You agree to provide accurate, complete and current information when creating an account or placing an order.

This includes your:

  • Name;

  • Billing address;

  • Shipping address;

  • Email address;

  • Telephone number; and

  • Payment information.

Customers are responsible for reviewing their shipping and billing information before completing an order.

W24Cards is not responsible for additional costs resulting from incorrect customer-supplied shipping information, subject to applicable law and our Refund, Return & Cancellation Policy.

You agree to promptly update your information when necessary.

SECTION 12 – PAYMENT

Payment must be successfully authorized before an order is processed unless W24Cards expressly agrees to another payment arrangement.

W24Cards may use third-party payment processors.

W24Cards does not directly control the policies, systems or availability of third-party payment processors.

Payment authorization may be declined or held for review by the payment processor, financial institution or W24Cards fraud-prevention systems.

Attempts to use unauthorized, fraudulent or stolen payment information may be reported to the appropriate financial institution, payment processor or authorities where appropriate.

SECTION 13 – SHIPPING AND DELIVERY

Shipping times displayed on our website or provided by a shipping carrier are estimates unless expressly stated otherwise.

W24Cards is not responsible for carrier delays caused by circumstances outside our reasonable control, including:

  • Weather;

  • Natural disasters;

  • Labour disruptions;

  • Customs;

  • Transportation interruptions;

  • Carrier network delays; or

  • Other events outside our control.

Customers are responsible for providing a complete and accurate delivery address.

Once an order has shipped, tracking information may be provided where available.

If an order is lost, damaged or undelivered, customers should contact W24Cards so that we can assist with the applicable carrier investigation.

Our Refund, Return & Cancellation Policy contains additional information regarding damaged, lost, returned and undelivered shipments.

Nothing in this section limits statutory rights relating to delivery or cancellation.

SECTION 14 – RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, exchanges and cancellations are governed by the W24Cards Refund, Return & Cancellation Policy, which forms part of these Terms.

Because of the nature of the collectibles market, certain products are final sale, including individual trading cards, professionally graded cards and opened sealed products, except where otherwise required by law or where an item was materially misrepresented or incorrectly supplied.

Customers should review the Refund, Return & Cancellation Policy before purchasing.

SECTION 15 – PRODUCT AVAILABILITY

All products are subject to availability.

Adding an item to a shopping cart does not reserve the product.

Products are generally reserved only after checkout has been successfully completed and the order has been accepted.

Inventory discrepancies may occasionally occur, particularly when products are offered through multiple sales channels.

If an item is unavailable after an order has been placed, W24Cards may cancel the affected item and issue the appropriate refund.

SECTION 16 – RESALE AND COMMERCIAL PURCHASING

Unless otherwise stated, products are offered for personal or legitimate commercial purchasing purposes.

W24Cards reserves the right to establish purchase limits for high-demand or allocated products to promote fair access to inventory.

Attempts to circumvent quantity restrictions by using multiple accounts, addresses or payment methods may result in cancellation of affected orders.

SECTION 17 – OPTIONAL THIRD-PARTY TOOLS

W24Cards may provide access to tools, services or integrations supplied by third parties.

These services may include:

  • Payment processing;

  • Shipping services;

  • Tracking tools;

  • E-commerce services;

  • Authentication services;

  • Social media integrations; or

  • Other website applications.

These third-party tools may be provided on an “as available” basis and may be governed by their own terms and privacy policies.

W24Cards is not responsible for the independent operation of third-party services outside our reasonable control.

SECTION 18 – THIRD-PARTY LINKS

W24Cards does not control and is not responsible for the content, accuracy, policies, security or practices of third-party websites.

Accessing a third-party website is at your discretion.

Transactions entered into directly with third parties are governed by the terms and policies of those third parties.

SECTION 19 – INTELLECTUAL PROPERTY

Unless otherwise indicated, website content created by W24Cards, including our:

  • Business name;

  • Logos;

  • Branding;

  • Original photographs;

  • Written descriptions;

  • Graphics;

  • Website design; and

  • Promotional materials

is owned by or licensed to W24Cards and may not be reproduced or commercially used without permission.

Product names, team names, league trademarks, manufacturer logos, player images and other third-party intellectual property remain the property of their respective owners.

The sale of a trading card or collectible does not imply endorsement, sponsorship or affiliation between W24Cards and any league, team, player, manufacturer or grading company unless expressly stated.

SECTION 20 – USER REVIEWS, COMMENTS AND SUBMISSIONS

If you submit a product review, comment, photograph, suggestion or other content to W24Cards, you represent that you have the right to submit that content.

Submitted content must not:

  • Infringe another person's intellectual property;

  • Contain unlawful material;

  • Contain malicious software;

  • Be knowingly false or misleading;

  • Impersonate another person; or

  • Contain abusive, threatening or discriminatory material.

W24Cards may moderate or remove content that violates these Terms.

You remain responsible for content you submit.

SECTION 21 – PERSONAL INFORMATION AND PRIVACY

Personal information submitted through W24Cards is handled in accordance with our Privacy Policy and applicable privacy legislation.

Information may be collected and used as reasonably necessary to:

  • Process transactions;

  • Fulfill and ship orders;

  • Communicate with customers;

  • Prevent fraud;

  • Maintain customer accounts;

  • Provide customer service;

  • Meet legal and regulatory requirements; and

  • Carry out other purposes identified in our Privacy Policy.

Third-party service providers may process information on our behalf where necessary to provide services such as payment processing, website hosting and shipping.

SECTION 22 – ERRORS, INACCURACIES AND OMISSIONS

Where an error materially affects an order that has already been placed, W24Cards may contact the customer regarding the error and, where appropriate, cancel the affected portion of the order and issue a refund.

You may not use the W24Cards website:

  • For unlawful or fraudulent purposes;

  • To violate applicable laws or regulations;

  • To infringe intellectual property rights;

  • To submit knowingly false or misleading information;

  • To transmit malicious code;

  • To improperly collect information belonging to others;

  • To spam, phish or engage in similar deceptive practices;

  • To scrape or extract website information through unauthorized automated means;

  • To interfere with website security;

  • To attempt unauthorized access to accounts or systems;

  • To circumvent product purchasing limits; or

  • To engage in conduct intended to disrupt the operation of the website.

W24Cards may restrict or terminate access to the website for violations of this section.

SECTION 24 – DISCLAIMER REGARDING COLLECTIBLE VALUES

Trading cards and collectibles are speculative products whose market values can increase or decrease significantly.

W24Cards does not provide financial, investment or professional valuation advice through the sale or description of a product.

Any price guide information, previous sales information, estimated value or market commentary provided by W24Cards is for general informational purposes only unless expressly stated otherwise.

We do not guarantee:

  • Future resale value;

  • Investment returns;

  • Market liquidity;

  • Future demand;

  • Future grading results; or

  • Appreciation in value.

Customers are responsible for making their own purchasing decisions.

SECTION 25 – DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the website and its services are provided on an “as available” basis.

W24Cards does not guarantee that access to the website will always be uninterrupted, secure or error-free.

Nothing in these Terms excludes or limits any warranty, condition, consumer protection or other right that cannot legally be excluded or limited.

SECTION 26 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, W24Cards and its owners, employees, contractors, service providers and affiliates will not be liable for indirect, incidental, special or consequential losses arising from the use of the website or products purchased through it.

This may include loss arising from changes in collectible market value, third-party grading results, manufacturer product configurations or third-party service interruptions.

Where liability cannot legally be excluded, W24Cards' liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms is intended to exclude liability or consumer rights where such exclusion is prohibited by law.

SECTION 27 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold W24Cards and its owners, employees, agents, contractors and service providers harmless from third-party claims arising from:

  • Your unlawful use of the website;

  • Your violation of these Terms;

  • Your infringement of another person's rights; or

  • Fraudulent or unauthorized activity carried out through your account.

This section does not apply where prohibited by applicable consumer protection legislation.

SECTION 28 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be limited or severed only to the extent necessary.

The remaining provisions will continue in effect.

SECTION 29 – TERMINATION

These Terms remain effective while you use the W24Cards website or services.

You may stop using our services at any time.

W24Cards may suspend or terminate access to an account or service where reasonably necessary because of a violation of these Terms, fraudulent activity, abusive behaviour, security concerns or unlawful activity.

Any obligations arising before termination will continue to apply where appropriate.

SECTION 30 – ENTIRE AGREEMENT

These Terms, together with the policies referenced within them, including our:

  • Refund, Return & Cancellation Policy;

  • Privacy Policy;

  • Shipping Policy; and

  • Any additional terms expressly applicable to a promotion or product

constitute the agreement governing your use of W24Cards and purchases made through our website.

If there is a conflict between these Terms and a specific written policy relating to a particular transaction, the more specific policy will apply to that issue unless prohibited by law.

SECTION 31 – NO WAIVER

If W24Cards does not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.

Any waiver must be expressly provided by W24Cards.

SECTION 32 – GOVERNING LAW

These Terms and purchases made through W24Cards are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without limiting any mandatory consumer protections that may apply to a customer.

Any dispute will be subject to the jurisdiction of the courts or applicable dispute-resolution bodies having jurisdiction in British Columbia, except where applicable law provides otherwise.

SECTION 33 – CHANGES TO THESE TERMS

W24Cards may update these Terms periodically to reflect changes to our business, website, products, services or legal requirements.

The current version will be posted on our website together with the date it was last updated.

Changes will generally apply prospectively.

The Terms in effect when an order is placed will generally govern that transaction unless a change is required by law.

Continued use of the website following publication of updated Terms constitutes acceptance of the updated Terms as they relate to future use of the website.
